Network Rail Guilty

Network Rail has been prosecuted for a crash that occurred in 2007.  The crash happened near Cumbrian village almost five years ago today.  One passenger died from injuries sustained during the crash.  The passenger was 84 at the time of her death.  Another 86 passengers and two workers on the train were injured.  The 300 tonne train derailed due to faulty points on the track.  The train was travelling at 95mph when it was thrown off the track.  The train comprised of nine rail cars.

Following the crash it was determined by HSE investigations and health and safety audits that the track needed to be repaired, but the issue had remained undiscovered.  Network Rail did admit their guilt in court stating that they did breach section 3(1) of the Health and Safety Act.  It was discovered the stretcher bars that are part of moveable rails did not operate properly thus causing the derailment.

Network Rail stated they would change how maintenance work is carried out and install new systems to ensure health and safety from now on.  The company also stated they regret the incident and their thoughts are with the family of Mrs Masson who died during the crash.  Network Rail will be fined, though the actual amount has yet to be released.  The sentence will be passed on April 2nd.  This means the fines they are facing will be announced on that date.

The company also stated the issue has affected those in the company; especially anyone working on the tracks, thus they want to ensure safety is provided to all.
